Frequently asked questions

How long do I have to challenge a dismissal?
The out-of-court challenge must be sent within 60 days of receiving the dismissal; within the following 180 days you must file a claim or start conciliation proceedings. These are strict time limits: once they expire, the right can no longer be enforced.
Can I still act if I have already signed a resignation?
It depends on the circumstances in which you signed. A resignation given under pressure, or a resignation for just cause, is treated differently from a voluntary one. It has to be assessed on the actual facts.
Will my employer find out that I have contacted a lawyer?
Only once you decide to take formal action. The initial assessment and the quote stay between you and the lawyer.
How much does an employment case cost?
You receive a written quote before instructing anyone, showing fees, out-of-pocket expenses and the court fee (contributo unificato) separately. In employment proceedings there are also income-based exemptions.
